Terms and Conditions of Use and Sale

1. About SiaraCash

SiaraCash, a SARL with share capital of 1,000,000 MAD, registered with the Commercial Registry of Rabat under numbers RC 177789 and ICE 00348732600000, with its registered office at Résidence Riad El Otor B N4 Bloc V, Avenue Annakhil Rabat, 10000, operates the website www.siaracash.ma. SiaraCash specializes in advisory and support services for the purchase and sale of used vehicles.

2. Purpose

The present Terms and Conditions of Use and Sale (hereinafter the "Terms") define the conditions under which users (hereinafter "Buyers" and "Sellers") can access the services offered by SiaraCash on www.siaracash.ma.

By using SiaraCash services, users acknowledge that they have read these Terms and agree to comply with them in full.

3. General Conditions

  • Exclusive sale mandate for sellers, with no digital listings (e.g. Avito).
  • Invoicing: every payment to SiaraCash gives rise to an invoice.
  • Deposit: minimum 3,000 MAD, final and made out to SiaraCash. Refundable under specific seller-cancellation conditions.
  • Administrative file fees include: NARSSA deposit, payment of stamps and local taxes, administrative follow-up, and technical inspection support.
  • Financing file fees include: file assembly, bank follow-up, full administrative support, vehicle transfer, technical inspection support, and processing of any pledge release.

4. Conditions of Sale — "Buyer" Client

4.1. Provision of truthful information

  • Provide SiaraCash with all requested information accurately, completely, and up to date.
  • Attest to the truthfulness of all documents and information provided.

4.2. Legal capacity

  • Be of legal age and legally capable of contracting under Moroccan law.

4.3. Knowledge of the vehicle

  • Familiarize yourself with the condition of the vehicle before purchase, including the results of the inspection carried out by SiaraCash.
  • Acknowledge that you are aware of the risks inherent to purchasing a used vehicle.

4.4. Waiver of warranties

  • Waive any right to rely on the warranty for hidden defects affecting the purchased vehicle, to the extent permitted by law.

4.5. Post-purchase liability

  • Assume all risks and responsibilities related to the use of the vehicle from the date of purchase.

4.6. Payment

  • Vehicle price: pay the purchase price directly to the name of the vehicle's owner (Seller), failing which the sale may be unilaterally cancelled by SiaraCash.
  • SiaraCash commission: pay the commission owed to SiaraCash at the time of vehicle acquisition.

4.7. Disputes

  • Agree that any dispute relating to this agreement falls under the exclusive jurisdiction of the Commercial Court of Rabat.

5. Conditions of Sale — "Seller" Client

5.1. Provision of truthful information

  • Provide SiaraCash with all requested information accurately, completely, and up to date.
  • Attest to the truthfulness of all documents and information provided.

5.2. Vehicle ownership

  • Be the legal owner of the vehicle being put up for sale.

5.3. Sale mandate

  • Accept without reservation the mandate given to SiaraCash to facilitate the sale of the vehicle.

5.4. Vehicle condition

  • Certify that the vehicle is in good general condition and has not suffered serious damage.

6. General Provisions

SiaraCash acts as an intermediary in the transaction between the Buyer and the Seller. SiaraCash is at no point the owner of the vehicles listed for sale on its platform.

7. Intellectual Property

SiaraCash places great importance on protecting its intellectual property. The entire site, its visual identity, texts, photos, videos, and logos are protected by copyright. Any reproduction or use without express authorization is prohibited.

8. Limitation of Liability

SiaraCash cannot be held liable for direct or indirect damages resulting from the use or inability to use the site or services.

9. Applicable Law and Jurisdiction

These Terms are governed by Moroccan law. Any dispute will be brought before the Commercial Court of Rabat.
